The right to bear arms is enshrined in the Second Amendment of the United States Constitution. However, South Carolina elected officials chose to temper the Constitutional right to bear arms with prudence and an eye toward public safety.

South Carolina gun and weapon charges can result from a number of different illegal activities. One of the more common gun and weapon charges in South Carolina stem from the improper sale of firearms. According to state law, firearms may not be sold to those who have been convicted of a violent crime or those under the age of 21.

Some types of weapons are specially regulated in the state of South Carolina. South Carolina Code of Law Title 16, Chapter 23, Sections 16-23-210 to 16-23-240 lists machine guns, sawed-off shotguns, sawed-off rifles, and military weapons as being illegal to possess, transport, or sell within the state. Gun and weapon charges resulting from violation of these sections carry hefty penalties. Each instance of violation is a felony and can cost the offender a fine of $10,000 or a ten year sentence in prison, or both.

Gun and weapon charges can also be levied against someone who is in possession of firearms on property owned by a private or public post-secondary school or public building. South Carolina also can press gun and weapon charges against those who carry a wide range of potentially deadly objects on the property of an elementary or high school. Both of these offenses are felonies in the state of South Carolina and carry heavy fines and penalties upon conviction.
