Sanders & Nettles, LLC has a strong record of success defending our clients who are accused of serious crimes including possession of drugs.

At Sanders & Nettles, LLC our drug possession attorneys believe that everyone, no matter what the charge, is entitled to a fair trial and an aggressive representation. Our Columbia SC drug possession defense attorneys have built a solid reputation for successfully defending drug possession charges. After decades of practicing law in South Carolina, we have the skills and experience to have your charges dropped or reduced or to get you the best possible penalties. If you're facing a misdemeanor or felony drug possession charge in South Carolina, it's extremely important to call the experienced drug possession attorneys at Sanders & Nettles as soon as possible.

A "tough on crime" attitude among politicians and law enforcement has created harsh penalties for drug possession crimes in South Carolina. Even cases with a very small amount of a narcotic, no violence and no trafficking may result in jail or prison time as well as a fine. In addition, the state will suspend your driver's license for six months for a marijuana or hashish conviction, and a year for all other narcotics convictions. Depending on the circumstances, you may also face loss of student financial aid, loss of a professional license, loss of your right to own or use a firearm or even seizure of your financial assets. And these are in addition to the social stigma of a drug-related conviction, which can follow you for years and create trouble at work, in your social life and in family court.

The following are the criminal penalties for simple possession as a first offense. Repeat offenses carry more time in jail or prison and steeper fines:

  • Marijuana, one ounce or less, or hashish, 10 grams or less: Up to 30 days in jail and $100 to $200 in fines.
  • Amphetamine, methamphetamine or larger amounts of marijuana or hashish: Up to six months in jail and up to $1,000 in fines.
  • Powder cocaine, up to 10 grams, LSD, up to 100 doses, or heroin, up to four grams: Up to two years of incarceration and up to $5,000 in fines.
  • Crack, crank and ice, less than one gram: Up to five years of incarceration and at least $5,000 in fines.
  • Anabolic steroids, up to 10 doses without a prescription: Up to six months of incarceration and up to $1,000 in fines.
  • Unfortunately, eagerness to build a case or moral convictions about drugs lead some law enforcement officers to make mistakes or violate the constitutional rights of the people they arrest. They may make illegal searches, fail to inform you of your rights or build a case around shaky evidence. At Sanders & Nettles, we always check for these types of errors in the cases against our clients facing drug charges. Our goal is to quickly find these types of errors and move to dismiss or reduce your charges, as appropriate. Unlike many lawyers we are trial lawyers. We believe any case worth taking is worth preparing for trial. However, after receiving the benefit of our experience you may decide to plead guilty, we can often negotiate with prosecutors to reduce your charges and find alternative penalties.

If you're facing drug possession charges in Charleston South Carolina, you're facing an uncertain future: the loss of your freedom, serious financial setbacks and missed future opportunities. That's why it's essential to call the experienced drug possession attorneys at Sanders & Nettles as soon as possible.
